BILL ANALYSIS H.B. 752 By: Rhodes (Armbrister) Criminal Justice 5-12-95 Senate Committee Report (Unamended) BACKGROUND Currently, the Texas Commission on Law Enforcement Officer Standards and Education has the authority and power to promulgate rules and regulations for administration, including establishing minimum standards for admission to employment as a peace officer, to approve institutions and facilities for schools for the purpose of training peace officers or recruits, and to operate schools and conduct courses, both preparatory, in-service, basic and advanced courses for peace officers and recruits. PURPOSE As proposed, H.B. 752 requires the Commission on Law Enforcement Officer Standards and Education to establish rules governing certain training programs and examinations. RULEMAKING AUTHORITY It is the committee's opinion that rulemaking authority is granted to the Commission on Law Enforcement Officer Standards and Education in SECTIONS 1 and 2 (Sections 415.031(e) and 415.056(e), Government Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 415.031, Government Code, by adding Subsection (e), to require the Commission on Law Enforcement Officer Standards and Education (commission) to establish, by rule, minimum qualifications for a person to enroll in a training program that provides instruction in defensive tactics, arrest procedures, firearms, or use of a motor vehicle for law enforcement purposes. Prohibits a person who is disqualified by law to be an officer or county jailer from enrolling in a training program described by this subsection. SECTION 2. Amends Section 415.056, Government Code, by adding Subsection (e), to require the commission, by rule, to establish minimum qualifications for a person to be examined under this section. Prohibits a person who is disqualified by law to be an officer or county jailer from taking an examination under this section. SECTION 3. (a) Effective date: September 1, 1995. (b) Requires the commission to adopt the rules required by Sections 415.031(e) and 415.056(e), Government Code, not later than January 1, 1996. SECTION 4. Emergency clause.
