BACKGROUND

     Currently, the terms of court for District Courts in the
238th, 318th and 385th Judicial Districts (all composed of Midland
County) commence on the first Monday in January and July of each
year.  The terms of court for the 142nd Judicial District (also
composed of Midland County) begins on the first Monday in March and
September of each year.


PURPOSE

     This bill changes the terms of the district court for the
142nd Judicial District to begin on the first Mondays in January
and July.


RULEMAKING AUTHORITY

     It is the committee's opinion that this bill does not
expressly grant any additional rulemaking authority to a state
officer, department, agency or institution.


SECTION BY SECTION ANALYSIS

     SECTION 1 amends Government Code § 24.243(b) to change the
terms of the 142nd District Court from beginning on the first
Mondays in March and September to beginning on the first Mondays in
January and July.

     SECTION 2.  Effective date.

     SECTION 3.  Emergency clause.


SUMMARY OF COMMITTEE ACTION

     Pursuant to a public notice posted March 8, 1995, in
accordance with House rules, the Committee on Judicial Affairs met
in a public hearing on March 14, 1995, to consider House Bill 767. 
The Chair recognized Rep. Goodman to explain the bill.  There were
no witnesses for, against or neutral on the bill.  Rep. Goodman
moved that H.B. 767 be reported back to the full House, without
amendment, with the recommendation that it do pass, be printed and
sent to the Committee on Local and Consent Calendars.  The motion
prevailed by the following record vote:  5 ayes, 0 nays, 0 PNV and
4 absent.
