BACKGROUND

The Children's Trust Fund of Texas was established by statute in
1985 to provide financial support for community-based efforts to
address child abuse and neglect.  In 1991, the Children's Trust
Fund was made a state agency.

PURPOSE

As proposed, H.B. 982 requires the Council on Child Abuse and
Neglect Prevention to develop an annual schedule of transfers of
money in the children's trust fund established under Chapter 74,
Human Resources Code, to the council's operating fund.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 74.003, Human Resources Code, to require
the Interagency Council on Child Abuse and Neglect Prevention
(council), among other duties, to develop a state plan for
expending funds for child abuse and neglect prevention programs
that includes an annual schedule of transfers of trust fund money
to the operating fund.  Authorizes the council to apply for and
receive funds made available by the federal or state government or
by another public or private source, which funds may be designated
and expended for administrative purposes and for grants for child
abuse and neglect prevention programs.

SECTION 2. Amends Section 74.005, Human Resources Code, as follows:

     Sec. 74.005.  New heading: ADMINISTRATIVE AND OTHER COSTS. 
     (a) Prohibits administrative costs during any fiscal year from
     exceeding an amount equal to 50 percent of the interest
     credited to the trust fund during the preceding fiscal year.
     
     (b) Prohibits funds expended under a special project grant
       from a nongovernmental source or a governmental source for
       public education or public awareness from being counted as
       administrative costs for the purposes of this section.
       
       SECTION 3.   Amends Section 74.006, Human Resources Code, by amending
Subsection (c), and adding Subsection (d), as follows:

     (c) Prohibits the council from transferring, during a fiscal
     year, more money deposited to the credit of the children's
     trust fund established by this chapter (trust fund) from any
     source, including interest and the amount credited under
     Section 118.022, Local Government Code, during the preceding
     fiscal year.  Authorizes money transferred to the operating
     fund that was originally deposited to the credit of the trust
     fund under Section 118.022, Local Government Code, to be used
     only for child abuse and neglect prevention programs.  Deletes
     language regarding the expiration date of this subsection.
     
     (d) Requires interest earned on money in the trust fund to be
     deposited to the credit of the trust fund.
     
     SECTION 4.     Amends Section 74.007(b), Human Resources Code, to
require administrative and other costs allowed in Section 74.005 to
be taken from the operating fund.  Deletes provisions regarding
interest.

SECTION 5. Amends Section 74.010(b), Human Resources Code, to
authorize the council to renew a grant not more than two times
unless certain circumstances as determined by the council require
an extension of the period.

SECTION 6. Effective date: September 1, 1995.

SECTION 7. Emergency clause.
