BILL ANALYSIS H.B. 1053 By: Raymond (Zaffirini) Health and Human Services 05-22-95 Senate Committee Report (Unamended) BACKGROUND Domestic violence accounts for nearly one-fourth of all violent crime in Texas. In fiscal year 1993, more than 750,000 women in Texas were physically or sexually abused by their husbands or partners. During the same period, Texas shelters housed 27,592 women and children; however, approximately another 9,600 victims were denied shelter services because no space was available. PURPOSE As proposed, H.B. 1053 sets forth provisions to maximize federal funding for programs to benefit victims of family violence. RULEMAKING AUTHORITY It is the committee's opinion that rulemaking authority is granted to the Texas Department of Human Services under SECTION 1 (Section 51.0051, Human Resources Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 51, Human Resources Code, by adding Section 51.0051, as follows: Sec. 51.0051. MAXIMIZING FEDERAL FUNDING FOR PROGRAMS TO BENEFIT VICTIMS OF FAMILY VIOLENCE. Requires the Texas Department of Human Services, in order to maximize the state's receipt of federal matching funds for emergency assistance under Part A, Title IV of the federal Social Security Act (42 U.S.C. Section 601 et seq.), to ensure that a contract made under Section 51.003 includes provisions necessary to maximize federal funding for services for victims of family violence, file amendments to the state's plan for aid and services to needy families with children under Part A, Title IV of the federal Social Security Act that are necessary to maximize federal funding, and establish by rule any reporting procedures that federal law requires as a condition of receiving federal matching funds. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
