BILL ANALYSIS H.B. 1225 By: Carona (Henderson) State Affairs 05-16-95 Senate Committee Report (Unamended) BACKGROUND Currently, military vehicles which have been restored for exhibitions, club activities, and parades are required to be registered under motor vehicle registration laws as passenger cars or trucks subject to state inspection and safety responsibilities. Most antique military vehicles are not used in regular transportation and do not have a means of displaying such registration. PURPOSE As proposed, H.B. 1225 sets forth exemptions for certain parade and antique military vehicles regarding inspection and registration. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 5a, Article 6675a-5a, V.T.C.S., by amending Subsections (a), (b), and (d) and adding Subsection (h), as follows: (a) Requires an application for a former military vehicle to include the vehicle's year of manufacture and a description of the vehicle containing information required by the Department of Transportation (TxDOT). Includes former military vehicles as vehicles which are to be exempt from the annual license fee for registration by TxDOT. (b) Provides that a former military vehicle operated on a public highway is not required to display license plates or any symbol, tab, or other device indicating registration of the vehicle if proof of current registration for the vehicle, in the form prescribed by TxDOT, is carried in the vehicle and the vehicle displays in a prominent location on the vehicle a registration mark prescribed by TxDOT. Requires TxDOT to allow use of a unique identification mark similar to the mark assigned that vehicle by the armed force in which the vehicle was used. Sets forth the requirements of the license plate TxDOT is required to provide if a symbol is not used. Requires the location and design of the registration mark to conform to the vehicle's official military design, to the extent possible. (d) Makes conforming and nonsubstantive changes. (h) Defines "former military vehicle." SECTION 2. Amends Article 6687-1, V.T.C.S., by adding Section 29A, as follows: Sec. 29A. Requires a certificate of title to be issued for a former military vehicle, as defined by Section 5a(h), Article 6675a-5a, V.T.C.S., regardless of whether the vehicle is registered under the laws of this state, if the requirements for issuance of a certificate of title, other than the registration requirement, are satisfied. SECTION 3. Amends Section 140(h), Article 6701d, V.T.C.S., to make conforming changes. SECTION 4. Amends Section 1A(b-2), Article 6701h, V.T.C.S., to make a conforming change. SECTION 5. Makes application of Section 5a, Article 6675a-5a, V.T.C.S., as amended by this Act, prospective. SECTION 6. Effective date: September 1, 1995. SECTION 7. Emergency clause.
