BILL ANALYSIS H.B. 1260 By: Denny 05-03-95 Committee Report (Unamended) BACKGROUND Currently, the Code of Criminal Procedure, Article 2.122, recognizes certain named criminal investigators of the United States as "Special Investigators". Under this article, special investigators are granted with the powers of arrest, search and seizure as to felony offenses only under the laws of the State of Texas, but they are not deemed peace officers. PURPOSE The purpose of HB 1260 is to include Marshals and Deputy Marshals of the United Sates Marshall Service as special investigators under the Code of Criminal Procedure, Article 2.122 so that they are recognized under the laws of the State of Texas. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 2.122(a), Code of Criminal Procedure, by adding (10) Marshals and Deputy Marshals of the United States Marshall Service to the list of special investigators. SECTION 2.
