BACKGROUND
Currently a teacher moving from another state must have ten or more
years of membership service credit in public schools to qualify for
insurance coverage.
PURPOSE
This bill would allow teachers to purchase out-of-state service
credit to qualify for insurance coverage with at least five years
of service, making it easier for districts that recruit some of
their teachers from other states.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.
SECTION BY SECTION ANALYSIS
SECTION 1: Section 823.401 is amended to add subsection (h) to
change the years of service credit from ten or more to at
least five.
SECTION 2: Effective date is September 1, 1995
SECTION 3: Emergency clause
SUMMARY OF COMMITTEE ACTION
Public notice was posted in accordance to the rules and a public
hearing was held on March 6, 1995.
Rep. Homer Dear testified as the bill's author.
Randy Mercer representing the Teacher Retirement System testified
neutrally on the bill.

The bill was referred to a subcommittee consisting of the following
members:
McCall-Chairman, Averitt & Rangel. On March 8, 1995, the
subcommittee met in a formal meeting. The bill was left pending.
On March 9, 1995, the subcommittee met in a formal meeting and
voted to report the measure without amendments.
On March 13, 1995, the full committee voted to report HB 1264 to
the House without amendment with the recommendation that it do pass
by a record vote of 6 ayes, 0 nays, 0 pnv and 3 absent.
