BILL ANALYSIS H.B. 1264 By: Dear (Sponsor) State Affairs 4-22-95 Senate Committee Report (Unamended) BACKGROUND Currently, a teacher moving from another state must have ten or more years of membership service credit in public schools to qualify for insurance coverage. PURPOSE As proposed, H.B. 1264 provides that a member of the Teacher Retirement System of Texas purchasing out-of-state service credit does not qualify for insurance coverage until the member has at least five years of membership service credit for actual service in public schools. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 823.401(h), Government Code, to provide that a member purchasing out-of-state service credit does not qualify for insurance coverage until the member has at least five, rather than 10 or more, years of membership service credit for actual service in public schools. SECTION 2. Emergency clause. Effective date: upon passage.
