BACKGROUND
This bill is the result of the Special House Committee on Small
Business Access to Capitol Report.
PURPOSE
To standardize the definition of a "small business" throughout the
Codes.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.
SECTION BY SECTION ANALYSIS
Section 1 - amends section 481.101(3)(c), Government Code
Subsection (3)(c) - defines a "small business" as one with 50
employees or less and also defines a "small business" as one
with annual gross receipts of up to $3 million.
Section 2 - amends section 481.191 (4), Government Code
refers to section 481.101(3)(c) for the definition of a "small
business"
Section 3 - amends section 481.231 (2), Government Code
refers to section 481.101(3)(c) for the definition of a "small
business"
Section 4 - amends section 481.301 (1), Government Code
refers to section 481.101(3)(c) for the definition of a "small
business"
Section 5 - amends section 2006.001 (1), Government Code
refers to section 481.101(3)(1) for the definition of a "small
business"
Section 6 - amends section 2006.011 (2), Government Code
refers to section 481.101(3)(1) for the definition of a "small
business"
Section 7 - amends Article 26.02 (21), Insurance Code
refers to section 481.101(3)(1) for the definition of a "small
business"
Section 8 - amends section 4.02 (d), Workforce and Economic
Competitiveness Act (Article 5190.7a, Vernon's Texas Civil
Statutes)
refers to section 481.101(3)(1) for the definition of a "small
business"
Section 9 - effective date September 1, 1995

EXPLANATION OF AMENDMENTS
COMMITTEE AMENDMENT #1 amends Article 26.02(21), Insurance Code.
This amendment is a technical correction and reinstates language
from the statute defining "small employer".
SUMMARY OF COMMITTEE ACTION
House Bill 1292 was considered in a public hearing on February 28,
1995.The committee considered one (1) amendment to the bill. The
one (1) amendment was adopted without objection. The following
person testified in favor of the bill:
