BILL ANALYSIS H.B. 1293 By: Carter (Madla) Economic Development 05-25-95 Senate Committee Report (Unamended) BACKGROUND Under current law, service providers of address databases used in providing 9-1-1 services are not immune from liability for providing 9-1-1 service. PURPOSE As proposed, H.B. 1293 provides that a service provider of an addressing system or address database used in providing 9-1-1 service, or an officer or employee of a service provider described by this subsection involved in providing 9-1-1 service, is not liable for any claim, damage, or loss arising from the provision of 9-1-1 service. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 771.053(a), Health and Safety Code, to provide that a service provider of an addressing system or address database used in providing 9-1-1 service, or an officer or employee of a service provider described by this subsection involved in providing 9-1-1 service, among others, is not liable for any claim, damage, or loss arising from the provision of 9-1-1 service unless the act or omission proximately causing the claim, damage, or loss constitutes gross negligence, recklessness, or intentional misconduct. SECTION 2. Effective date: September 1, 1995. Makes application of this Act prospective. SECTION 3. Emergency clause.
