BILL ANALYSIS H.B. 1302 By: Greenberg 3-13-95 Committee Report (Unamended) BACKGROUND Tanglewood Forest Municipal Utility District ( the MUD) is located in the City of Austin, near the corner of Slaughter and Manchaca, and it is almost entirely built-out with over 1700 connections. Kocurek Elementary is in the middle of the district. The original developers installed some street lights, however, significant portions of the district are without street or security lighting, and considerably dark at night. The Board of Directors of the MUD wanted to buy the streetlights from the city and have them installed, at an estimated cost of $30,000, however, the MUD and the City of Austin were unable to complete this transaction because the parties had no statutory authority to do so. PURPOSE To allow the district to use general operating funds to install, operate, and maintain street or security lighting within that district. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS Section 1. Defines "district" to mean Tanglewood Forest Municipal District. Section 2. Provides that, in spite of Section 54.236, Water Code, the MUD may use general operating funds to install, operate, and maintain street or security lighting in a specified area within the district provided that (1) the area has had water utilities and streets installed for eight years, and (2) the developer of the area has not installed street or security lighting as required as a condition under Section 54.016, Water Code. Section 3. Emergency Clause. SUMMARY OF COMMITTEE ACTION H.B.1302 was considered by the committee in a public hearing on March 13, 1995.
