BACKGROUND

The Legislature instructed the Texas Department of Transportation
to construct, repair, and maintain roads in and adjacent to State
Parks with enactment of Legislation in 1991.  (Section 1.02,
Chapter 7, Acts of the 72nd Legislature, 1st called session).

PURPOSE

The purpose of H.B. 1359 is to expand the types of Texas Parks and
Wildlife Department facilities for which TxDOT will construct,
repair, and maintain roads.  The expansion includes Wildlife
Management Areas, state fish hatcheries, and support facilities.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 1.02, Chapter 7, Acts of the 72nd
Legislature, 1st Called Session, 1991, and adds state fish
hatcheries, state wildlife management areas, and support facilities
for parks, fish hatcheries, and wildlife management areas.

SECTION 2.  Effective Date, September 1, 1995

SECTION 3.  Emergency Clause.

EXPLANATION OF AMENDMENTS

Committee Amendment #1 amends H.B. 1359 on page 1, line 12 after
"management areas." by adding the following:

Where the Parks and Wildlife Department has no easement, right-of-way or similar access to or in a state park, state fish hatchery,
state wildlife management area or support facility, none may be
obtained hereunder without the express written consent of all
affected private landowners.

SUMMARY OF COMMITTEE ACTION

Pursuant to a public  notice posted on April 7, 1995 at 5:04 p.m.,
the House Committee on Transportation met in a public hearing on
Wednesday, April 12, 1995, at 2:00 p.m., or upon adjournment, in
Room E1.014 of the Capitol Extension and was called to order at
3:58 p.m. by the Chair, Representative Clyde Alexander.  The Chair
laid out H.B. 1359 and recognized Representative Alexander to
explain H.B. 1359.  The Chair recognized the  following persons who
testified but were neutral on H.B. 1359.  Bobbie Templeton, Texas
Department of Transportation.  Penny Barneky, Texas Parks and
Wildlife Department.  The Chair left H.B. 1359 pending before the
Committee.  Pursuant to a public notice posed on April 13, 1995 at
4:14 p.m., the House Committee on Transportation met in a public
hearing on Wednesday, April 19, 1995 at 2:00 p.m., or upon
adjournment, in Room E1.014 of the Capitol Extension and was called
to order at 2:16 p.m. by the Chair, Representative Clyde Alexander. 
The Chair laid out H.B. 1359 by Alexander, which was pending before
the Committee.  Representative Bosse laid out Committee amendment
#1, and without objection, Committee amendment #1 was adopted. 
Representative Bosse moved that the Committee report H.B. 1359, as
amended, to the full House with the recommendation that it do pass. 
The motion prevailed by the following vote: Ayes (6), Nayes (0),
Absent (3), Present not voting (0).
