BILL ANALYSIS H.B. 1359 By: Alexander (Wentworth) State Affairs 5-22-95 Senate Committee Report (Unamended) BACKGROUND In 1991, the 72nd Legislature enacted legislation instructing the Texas Department of Transportation to construct, repair, and maintain roads in and adjacent to state parks. PURPOSE As proposed, H.B. 1359 expands the list of facilities for which the Texas Department of Transportation is required to construct, repair, and maintain roads to include roads in and adjacent to fish hatcheries, wildlife management areas, and support facilities for parks, fish hatcheries, and wildlife management areas. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 1.02, Chapter 7, Acts of the 72nd Legislature, 1st Called Session, 1991, to expand the list of facilities for which the Texas Department of Transportation is required to construct, repair, and maintain roads to include roads in and adjacent to fish hatcheries, wildlife management areas, and support facilities for parks, fish hatcheries, and wildlife management areas. Provides that where the Parks and Wildlife Department has no easement, right-of-way, or similar access to or in a state park, state fish hatchery, state wildlife management area, or support facility, none may be obtained without the express written consent of all affected private landowners. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
