BILL ANALYSIS H.B. 1381 By: Glaze 3-27-95 Committee Report (Unamended) BACKGROUND Ballots for the election of the members of the board of directors of the Van Zandt County Waste Disposal District are printed 45 days prior to the election of the board of directors. Currently, a prospective candidate must file a petition 30 days prior to the election. The 30 day allotment is not sufficient time to have the ballots printed; therefore, Section 3.04(b), Chapter 1256, Acts of the 71st Legislature, Regular Session, 1989, is amended by extending the filing deadline to 60 days before the election. PURPOSE To require a prospective candidate for director to file his petition 60 days prior to the election. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS Section 1. Amends section 3.04(b), Chapter 1256, as follows: Section 3.04(b) a person who desires to have his name printed on the ballot at a director's election as a candidate for director shall file a petition with the secretary of the district before the 60th day preceding the date of the election. Section 2. Emergency clause. SUMMARY OF COMMITTEE ACTION H.B.1381 was considered by the committee in a public hearing on March 27, 1995. No testimony was received. The bill was reported favorably without amendment, with the recommendation that it do pass and be printed and be sent to the Committee on Local and Consent Calendars, by a record vote of 7 ayes, 0 nays, 0 pnv, 2 absent.
