BILL ANALYSIS H.B. 1417 By: Turner, Sylvester 04-12-95 Committee Report (Unamended) BACKGROUND Under present law, upon the death of an individual entitled to benefits as a member of the Houston Police Officer's Pension System, the surviving spouse continues to receive the deceased spouse's pension allotment. Current law mandates that a survivor's benefit cease when the surviving spouse remarries. PURPOSE To permit a surviving spouse of a deceased member to remarry and continue to receive a survivor's benefit from the Pension System. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1: Amends Section 13(a), Article 6243g-1, V.T.C.S., by deleting references to widows or widowers receiving pension benefits after remarriage. SECTION 2: Amends Section 1(p), Article 6243g-3, V.T.C.S., by deleting references to widows or widowers receiving pension benefits after remarriage. SECTION 3: Amends Section 21(b), Article 6243g-3, V.T.C.S., by deleting references to widows or widowers receiving pension benefits after remarriage. SECTION 4: Repeals Section 2(j), Article 6243g-1, V.T.C.S., which defines the terms "widow" and "widower."
