BACKGROUND

     Prosecutors who are placed under the Professional Prosecutors
Act may not engage in the private practice of law.  In exchange,
they are entitled to compensation from the State equal to that paid
to a district judge.


PURPOSE

     House Bill 1523 adds the district attorney for the 156th
Judicial District to the Professional Prosecutors Act.


RULEMAKING AUTHORITY

     It is the committee's opinion that this bill does not
expressly grant any additional rulemaking authority to a state
officer, department, agency or institution.


SECTION BY SECTION ANALYSIS

     SECTION 1 amends Government Code § 46.002 to include the
district attorney for the 156th Judicial District to the
Professional Prosectors Act.


SUMMARY OF COMMITTEE ACTION

     Pursuant to a public notice posted March 8, 1995, in
accordance with House rules, the Committee on Judicial Affairs met
in a public hearing on March 14, 1995, to consider House Bill 1523. 
The Chair recognized the author, Rep. Hawley, to explain the bill. 
George P. Morrill, II, district attorney for the 156th Judicial
District, testified for H.B. 1523.  There were no other witnesses
for, against or neutral on the bill.  Rep. Nixon moved that H.B.
1523 be reported back to the full House, without amendment, with
the recommendation that it do pass, be printed and sent to the
Committee on Local and Consent Calendars.  The motion prevailed by
the following record vote:  6 ayes, 0 nays, 0 PNV and 3 absent.
