BILL ANALYSIS H.B. 1523 By: Hawley (Zaffirini) Jurisprudence 5-3-95 Senate Committee Report (Unamended) BACKGROUND Prosecutors who are placed under the Professional Prosecutors Act may not engage in the private practice of law. In exchange, these prosecutors are entitled to compensation from the state equal to that paid to a district judge. PURPOSE As proposed, H.B. 1523 applies the Professional Prosecutors Act to the district attorney for the 156th Judicial District. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.002, Government Code, to include the district attorney from the 156th Judicial District in the list of prosecutors to which the Professional Prosecutors Act applies. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
