BILL ANALYSIS H.B. 1600 By: Serna (Sponsor) Water 05-03-95 Senate Committee Report (Unamended) BACKGROUND Currently, the El Paso County Lower Valley Water District Authority is the name of the conservation and reclamation district that was established by the 69th Legislature in 1985. After the authority's creation, the board of directors of the authority noted that the name under which the authority was created is too long and cumbersome, and, as a consequence, is rarely used in its entirety. The name has caused confusion regarding its relationship to the County of El Paso and with other districts and authorities in the county. PURPOSE As proposed, H.B. 1600 changes the name of the El Paso County Lower Valley Water District Authority to the Lower Valley Water District. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 1, Chapter 780, Acts of the 69th Legislature, Regular Session, 1985, as follows: Sec. 1. Creates a conservation and reclamation district to be known as the Lower Valley Water District, rather than the El Paso County Lower Valley Water District Authority. SECTION 2. Amends Section 2A, Chapter 780, Acts of the 69th Legislature, Regular Session, 1985, to make a conforming change. SECTION 3. Amends Section 3(g), Chapter 780, Acts of the 69th Legislature, Regular Session, 1985, to make a conforming change. SECTION 4. Declares that the name change made by this Act does not affect the obligations or powers of the entity formerly known as the El Paso County Lower Valley Water District Authority. SECTION 5. Emergency clause. Effective date: upon passage.
