BILL ANALYSIS C.S.H.B. 1652 By: Tillery 4-26-95 Committee Report (Substituted) BACKGROUND Current law provides that sheriff's departments in a county with a population of 2,000,000 or more maintain a permanent personnel file on each employee. PURPOSE As proposed, CSHB 1652 will assist sheriffs in and their departments, in small and large counties, in developing employee relations and standardizing employee work performance documentation. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS Section 1: Amends Section 157.904(a) and (c) as follows: (a) This section applies only to a sheriff's department in a county with a population of 100,000 or more. (c) In a county with a population of 2,000,000 or more, the sheriff or his designee shall maintain a permanent file on each department employee. In any county to which this section applies, and in which the sheriff or his designee maintains a permanent file, the file must contain currently required information. Section 2: Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE The original bill lowered the population bracket from 2,000,000 to 100,000 in subsection (a) of the bill. The committee substitute lowers the population bracket as well and adds that in a county with a population of 2,000,000 or more, the sheriff or his designee shall maintain a permanent file on each department employee. The committee substitute also adds that in any county to which this section applies, and in which the sheriff or his designee maintains a permanent file, the file must contain the currently required information.
