BILL ANALYSIS H.B. 1652 By: Tillery (Armbrister) Criminal Justice 05-22-95 Senate Committee Report (Unamended) BACKGROUND Currently, sheriff's departments in counties with a population of 2,000,000 or more maintain a permanent personnel file on each employee. PURPOSE As proposed, H.B. 1652 requires the sheriff or the sheriff's designee, in a county with a population of 100,000 or more, to maintain a permanent personnel file on each sheriff's department employee. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 157.904(a) and (c), Local Government Code, as follows: (a) Provides that this section applies only to a sheriff's department in a county with a population of 100,000, rather than 2,000,000, or more. (c) Requires the sheriff or the sheriff's designee, in a county with a population of 2,000,000 or more, to maintain a permanent personnel file on each sheriff's department employee. Sets forth the required contents of an employee personnel file in any county to which this section applies and in which the sheriff or the sheriff's designee maintains a permanent personnel file. SECTION 2. Emergency clause. Effective date: upon passage.
