BILL ANALYSIS H.B. 1687 By: Alonzo (Gallegos) Criminal Justice 5-23-95 Senate Committee Report (Amended) BACKGROUND Currently, law enforcement officials must orally notify the superintendent or a representative of the superintendent within 24 hours after a crime has been committed by a student. The superintendent, however, is not required to notify teachers or support staff of the student's criminal activity. PURPOSE As proposed, H.B. 1687 requires superintendents to inform instructional and support personnel of students who have committed crimes with whom they have regular contact. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 15.27(a), Code of Criminal Procedure, to require the superintendent to promptly notify all instructional and support personnel who have regular contact with a student who is arrested or taken into custody. Requires all personnel to keep the information received in this subsection confidential. Authorizes the State Board for Educator Certification to revoke or suspend the certification of personnel who intentionally violate this subsection. SECTION 2. Makes application of this Act prospective beginning in the 1995-1996 school year. SECTION 3. Emergency clause. Effective date: upon passage.
