BILL ANALYSIS H.B. 1717 By: Turner, Sylvester April 12, 1995 Committee Report (Unamended) BACKGROUND In a bill that amended the applicable statute in the 73rd Legislature, a portion of the law was inadvertently worded so as to remove the pension system's ability to pay benefits to certain retirees. PURPOSE To reinstate the pension system's ability to pay pensions to certain retired members by inserting language to clarify who may receive benefits. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1: Amends Section 4, Police Officers' Pension System in cities of 1,200,000 or more (Article 6243g-1, V.T.C.S.), by adding that a person who became a member of the pension system before September 1, 1981 and who did not elect before January 1, 1982, to become a member of the plan governed by Article 6243g-3, V.T.C.S., would be entitled to receive benefits upon meeting service requirements.
