BILL ANALYSIS H.B. 1719 By: Hilderbran 4-4-95 Committee Report (Unamended) BACKGROUND Currently, proprietors of businesses allowing the sale or service of alcoholic beverages for on-premise consumption, who desire to alter the form of business (proprietorship or corporation) under which such a permit is held, must purchase a new permit for each licensed premise. PURPOSE H.B. 1719 would allow the holder of a on-premise consumption permit to alter the form of business, pay a fee, and to continue with the privileges granted under the prior business form. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 11, Alcoholic Beverage Code by adding a new Section 11.12. Sec. 11.12. Provides that proprietors may alter the form of business under which a permit allowing the sale or service of alcoholic beverages for on-premise consumption is held by paying a fee of $100 for each licensed premise, provided that the ownership interest in the new business form is substantially similar to that of the prior form. Section 2. Emergency clause. SUMMARY OF COMMITTEE ACTION HB 1719 was heard in a Public Hearing on March 29, 1995. Representative Jones moved that the full committee adopt H.B. 1719 and that it be reported favorably to the full House, with the recommendation that it do pass and be printed.
