BILL ANALYSIS H.B. 1719 By: Hilderbran (Gallegos) State Affairs 5-25-95 Senate Committee Report (Unamended) BACKGROUND Proprietors of businesses allowing the sale or service of alcoholic beverages for on-premise consumption who desire to alter the form of business under which such a permit is held must purchase a new permit for each licensed premise. PURPOSE As proposed, H.B. 1719 authorizes the holder of a permit to sell or serve alcoholic beverages for on-premise consumption to alter the form of business under which a permit is held if the ownership is substantially similar to that of the prior form by paying a fee. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 11A, Alcoholic Beverage Code, by adding Section 11.12, as follows: Sec. 11.12. CHANGE IN FORM OF OWNERSHIP. Authorizes the holder of a permit to sell or serve alcoholic beverages for on-premise consumption (permit holder) to alter the form of business under which a permit is held if the ownership is substantially similar to that of the prior form unless the physical location of the business is within 1,000 feet of the property line of a public school. Defines "substantially similar." Requires the permit holder changing the form of ownership of the business to pay a fee of $100 for each licensed premise, and requires the new business form to succeed to all the privileges of the prior business form in the permit. SECTION 2. Emergency clause. Effective date: 90 days after adjournment.
