BILL ANALYSIS H.B. 1763 By: Brimer (Rosson) State Affairs 5-12-95 Senate Committee Report (Unamended) BACKGROUND Currently, a Texas brewery cannot legally enter a beer tasting competition that is not on the premises of the brewery. PURPOSE As proposed, H.B. 1763 authorizes Texas brewpubs to enter a product into an organized beer tasting, competition, or review. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 74.01, Alcoholic Beverage Code, by adding Subsection (g), to authorize a holder of a brewpub license to deliver malt liquor, ale, or beer (beer) manufactured by the holder to a location other than the holder's premises for the purpose of submitting the beer for an evaluation at an organized beer tasting, competition, or review. Authorizes a holder of a brewpub license to dispense without charge beer manufactured by the holder to a person attending the event for consumption on the premises of the event and discuss with a person attending the event the manufacturing and characteristics of the beer at a beer tasting. SECTION 2. Emergency clause. Effective date: upon passage.
