BACKGROUND

Currently, the Nueces County Hospital District Board of Managers is
appointed to serve on the Board by the Commissioners of Nueces
County with no expiration of terms.

PURPOSE

The purpose of this bill s to allow for continuity of experience on
the board of managers of the Nueces County Hospital District.
Currently, the terms of all board members expire at the same time.
The expertise and understanding needed to serve on the board cannot
be achieved if all of the members leave the position at the same
time.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

Section 1.   Amends Section 281.022, Health and Safety Code, as
follows:

     Subsection (a):     Letters new subsection (a).

     Subsection (b):     Sets three-year staggered terms for the
     members of the board of managers of the Nueces County Hospital
     District.  As close to one-third of the members terms expiring
     each year.

Section 2. 

     Subsection (a):     Effective date September 1, 1995.

     Subsection (b):     Allows current members of the Board to
     draw lots or another method to determine which members will
     serve a term expiring in 1998, 1997, or 1996.  The number of
     members serving each term length shall be as close to one-third of the membership as possible.

     Subsection (c):     Upon the determination of which members
     shall serve each term length, this subsection instructs the
     commissioners court to determine on what date terms expire
     each year.

Section 3. Emergency clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

The original bill stated that the members of the board of hospital
managers would serve staggered four year terms with as near as
possible to one-half of the members' terms expiring in each odd-numbered year. The committee substitute states that the members of
the board will serve staggered three year terms, with as near as
possible to one-third of the member's terms expiring each year.
The original bill, in Section 2 (b), requires drawing lots to
determine members, the number of whom must be as near as possible
to half of the total number of members, who may serve terms that
expire in 1999 and the members, the number of whom must be as near
as possible to half of the total number of members, who shall serve
term that expire in 1997.   
The committee substitute, in Section 2 (b), allows for the drawing
of lots or another method to determine members, the number of whom
must be as near as possible to one-third of the total number of
members, who shall serve terms that expire in 1998, the members,
the number of whom must be as near as possible to one-third of the
total number of members, who shall serve terms that expire in 1997,
and the members, the number of whom must be as near as possible to
one-third of the total number of members, who shall serve terms to
expire in 1996.
The original bill required the commissioners court to establish the
specific date on which the terms of members of the board of
managers shall expire on each odd-numbered year, whereas the
committee substitute states that the commissioners court shall
establish the specific date on which the terms of members of the
board of managers shall expire each year.

SUMMARY OF COMMITTEE ACTION

HB 1818 was considered by the County Affairs Committee in public
hearing on 3/29/95. Representative V. Luna opened and closed. The
Committee on County Affairs considered a complete committee
substitute for HB 1818. The substitute was adopted without
objection. HB 1818 was reported favorably as substituted with the
recommendation that it do pass and be printed and be sent to the
Committee on Local and Consent Calendars, by the record vote of 8
ayes, 0 nays, 0 pnv, 1 absent.
