BACKGROUND

There has been a move by law enforcement, concerned parents and
citizens to prevent teenagers from exposure to a life that by most
accounts can contribute to, among other things; illicit drug use,
sexual abuse, and prostitution.  There is great sentiment that the
legal age at which a person, male or female, should be permitted to
work in such an environment be at least equal to the legal age for
consumption of alcoholic beverages, twenty-one (21) years of age. 
   

PURPOSE

To require the commission or administrator of the Texas Alcoholic
Beverage Commission (TABC) to cancel a license or permit if the
holder employs, authorizes, or induces a person under 21 years of
age to work in a sexually oriented commercial activity or a place
that requires a person to work nude. 

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 106, Alcoholic Beverage Code, by adding
Section 106.15.

Sec. 106.15.  EMPLOYMENT HARMFUL TO PERSONS YOUNGER THAN 21. 
Requires the commission or administrator to cancel a license if the
holder employs, authorizes, or induces a person younger than 21 to
work on the premises of (1) a sexually oriented commercial
activity; or (2) a place of business requiring a person to work
nude.  Defines "nude" and "sexually oriented commercial activity". 


SECTION 2.  Effective Date:  September 1, 1995.

SECTION 3.  Emergency Clause.


SUMMARY OF COMMITTEE ACTION

HB 1872 was heard in a Public Hearing on March 29, 1995.  The Chair

HB 1872 was left pending in committee.  HB 1872 was heard in a
Formal Meeting on April 4, 1995.  Representative Kubiak moved that
the full committee adopt H.B. 1872, and that it be reported
favorably to the full House with the recommendation that it do pass
and be printed.  The motion prevailed by the following vote: AYES:
(9), NAYS: (0), ABSENT: (0).
