BACKGROUND

Presently breweries may dispense beer for on-premises consumption. 
Similar to the wine industry, samples are often given out after a
tour of the brewery.  These tours and tasting are an integral part
of the marketing that breweries need to thrive as a tourist
industry.  Although breweries produce ale as well as beer, they are
only allowed to give samples of beer to touring groups.  With the
growing brewpub industry in Texas, tasting on the premises will
become a much needed tool to allow these small brewpubs to grow.


PURPOSE

HB 1922 would allow the holder of a brewer's permit to dispense ale
and malt liquor for consumption on the premises.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 12.01, Alcoholic Beverage Code, 

Authorizes the holder of a brewer's permit to dispense ale and malt
liquor for consumption on the premises.

SECTION 2.  Emergency clause.  Effective upon passage. 


SUMMARY OF COMMITTEE ACTION

HB 1922 was heard in a Public Hearing on April 11, 1995.  The Chair
recognized the following person to testify as a resource witness,
registering neutral on the bill:
     Mr. Randy Yarbrough, Asst. Admin., TABC;
The Chair recognized Rep. Maxey to close.  HB 1922 was left pending
in committee.  HB 1922 was considered in a Formal Meeting on April
21, 1995.  The Chair laid out HB 1922 which was pending in
committee.  There was no objection.  Rep. Wilson moved that the
full committee adopt HB 1922, and that it be reported favorably to
the full House with the recommendation that it do pass and be
printed and placed on the Local and Consent Calendar.  The motion
prevailed by the following vote:  AYES: 7, NAYS: 0, ABSENT: 2.
