BILL ANALYSIS H.B. 1956 By: Grusendorf (Nixon) Natural Resources 05-19-95 Senate Committee Report (Unamended) BACKGROUND The House Committee on Agriculture and Wildlife Management learned during its 1994 review of state agency reports that the Parks and Wildlife Department is required to file many reports for the legislative and executive branches of state government. These reports contain information that is generally not utilized so the committee recommended that the department be relieved of the duty to publish many of these reports, including the Salt Water Finfish Report which was initiated when the legislature was more directly involved in the state's coastal finfish resources. PURPOSE As proposed, H.B. 1956 deletes language requiring the Parks and Wildlife Department to issue a report based on continuous finfish research done by the department. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 66.217, Parks and Wildlife Code, as follows: Sec. 66.217. FINFISH RESEARCH. (a) Makes no changes. (b) Deletes language requiring the Parks and Wildlife Department (department) to issue reports based on finfish research required by Subsection (a) of this section. (c) Deletes language requiring the reports to be filed in the permanent records of the department. Deletes existing Subsection (d) regarding the required contents of the report. Deletes existing Subsection (e) requiring the department to make a special report to the governor and the legislature on studies, findings, recommendations, and actions taken under this subchapter. SECTION 2. Repealer: Sections 12.002, 24.010, 28.005, and 77.006, Parks and Wildlife Code (Report to Governor-Annual Report-Report-Department Findings and Report). SECTION 3. Emergency clause. Effective date: upon passage.
