BILL ANALYSIS H.B. 1976 By: Janek (Brown) State Affairs 05-22-95 Senate Committee Report (Unamended) BACKGROUND Currently, the City of Bellaire maintains a strip of land owned by the state as a public park. PURPOSE As proposed, H.B. 1976 allows the Texas Department of Transportation to convey a tract of land to the City of Bellaire to be used as a public park. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. AUTHORIZATION FOR CONVEYANCE. (a) Requires the Texas Department of Transportation to convey without compensation, on behalf of the state, all of the interest of the state in the real property described by Section 3 of this Act and all improvements on the property to the City of Bellaire (Bellaire). (b) Provides that this conveyance is in recognition of the development of the property described by Section 3 of this Act by Bellaire as a public park and the city's continued maintenance of the property as a public park. (c) Provides that Section 31.158, Natural Resources Code, and Chapter 99, Article 6673a, V.T.C.S., do not apply to the conveyance authorized by this section. SECTION 2. REVERSION OF TITLE. Provides that if Bellaire ceases to use the real property described by Section 3 of this Act as a public park, all right, title, and interest in the property reverts to the state. SECTION 3. PROPERTY DESCRIPTION. Sets forth the description and location of the property. SECTION 4. Emergency clause. Effective date: upon passage.
