BACKGROUND

School Districts located in small towns have difficulty in hiring
substitute teachers due to the small employment pool.  While
relatives of school board members are generally interested and
eligible, they are prohibited from serving as substitutes by
nepotism statutes governing the board.

PURPOSE

This bill would allow relatives of school board members to serve as
substitute teachers in districts located in towns smaller than
2,000.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

Section 1.  Adds employment of a substitute teacher by a district
located in a municipality smaller than 2,000 population to the
lists of exemptions from the nepotism statute.  Employment of a
personal attendant for a person with physical infirmities is
conforming language.

Section 2.  Conforming language.

Section 3.  Emergency clause.

SUMMARY OF COMMITTEE ACTION

HB 2000 was considered by the committee in a public hearing on
April 10, 1995.  The following person testified in favor of the
bill:  Dr. Ray Freeman, representing Italy ISD.  The bill was left
pending.  HB 2000 was considered by the committee in a public
hearing on April 13, 1995.  The bill was reported favorably,
without amendment, with the recommendation that it do pass and be
printed, by a record vote of 8 ayes, 1 nay, 0 pnv, 0 absent.
