BACKGROUND

Currently, there is a discrepancy concerning the salary of a county
court judge and the salary of a district judge in Potter County. 
The language in Gov. Code Section 25.1902 (h) (Vernon Supp. 1995)
could be interpreted so that the county court judge is eligible to
receive a higher salary than the district judge, which differs from
the rest of the state.

PURPOSE

As proposed, HB 2020 repeals the language in Gov. Code Section
25.1902 (h) (Vernon Supp. 1995) so that the language in the
statutes applying to Potter County is consistent with Gov. Code
Section 25.005(a) (Vernon Supp. 1995) that states the salary of the
county court judge is $1000 less than the salary of the district
judge.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SUMMARY OF COMMITTEE ACTION

HB 2020 was considered by the County Affairs Committee in a public
hearing on 3/29/95. Representative Swinford opened and closed. HB
2020 was reported favorably with the recommendation that it do pass
and be printed and be sent to the Committee on Local and Consent
Calendars, by a record vote of 7 ayes, 0 nays, 0 pnv, 2 absent.
