BILL ANALYSIS H.B. 2035 By: Hamric (Nelson) Criminal Justice 05-22-95 Senate Committee Report (Unamended) BACKGROUND Currently, Texas law only allows justice and municipal courts to suspend the driver's license of a minor who fails to take care of a traffic offense. PURPOSE As proposed, H.B. 2035 authorizes justice and municipal courts to suspend a driver's license of a person who is under 17 years of age for a failure to appear or a default in payment of a fine for a misdemeanor punishable by a fine only. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 22(b), Article 6687b, V.T.C.S., to authorize the director of the Department of Public Safety to suspend or revoke a driver's license if the person has been reported by a justice or municipal court for failure to appear or a default in payment of a fine for a misdemeanor punishable by a fine only, other than an offense covered under Subdivision (16) of this subsection, committed by a person who was under 17 years of age at the time of the alleged offense, unless the court has filed an additional report on final disposition of the case. Makes conforming changes. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
