BILL ANALYSIS H.B. 2069 By: Hill (Sponsor) Intergovernmental Relations 5-10-95 Senate Committee Report (Amended) BACKGROUND Chapter 43, Local Government Code, is entitled "Municipal Annexation" and contains the general authority and procedures for cities to annex property, special districts, special types of property, disannexation, and for limited purposes. Chapter 43G, Local Government Code, contains the provisions regulating disannexation. Subchapter G contains no provisions regulating the width of property disannexed by a city. PURPOSE As proposed, H.B. 2069 requires cities disannexing a road or highway to disannex a strip along a roadway or highway. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 43G, Local Government Code, by adding Section 43.147, as follows: Sec. 43.147. WIDTH REQUIREMENT FOR DISANNEXATION. (a) Requires a municipality disannexing a road or highway to also disannex a strip of area that is equal in size to the minimum area that the municipality is required to annex in order to comply with the width requirements of Section 43.054, unless such disannexation is undertaken with the mutual agreement of the county government and the municipality. (b) Requires the strip of area to be disannexed to be adjacent to either side of the road or highway and to follow the course of the road or highway. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
