BILL ANALYSIS H.B. 2177 By: Jackson (Patterson) Natural Resources 5-25-95 Senate Committee Report (Unamended) BACKGROUND Currently, many navigation district contracts and sales of surplus land result in frivolous lawsuits that are based on small technicalities concerning formalities. PURPOSE As proposed, H.B. 2177 validates and conforms the acts, proceedings, commissioners, bonds, and obligations of navigation districts. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Defines "district" to mean a navigation district. SECTION 2. Validates and confirms all acts and proceedings of a navigation district taken before the effective date of this Act; all commissioners or other officials of a district that took office before the effective date of this Act; all bonds or other obligations of a district authorized before the effective date of this Act, including all proceedings taken before the effective date of this Act that are related to those bonds or other obligations. SECTION 3. Provides that Section 2 does not apply to an act, proceeding, commissioner or official, bond, or obligation the validity of which or whom is the subject of litigation that is pending on the effective date of this Act. SECTION 4. Emergency clause. Effective date: upon passage.
