BILL ANALYSIS H.B. 2200 By: Yarbrough 4-11-95 Committee Report (Unamended) BACKGROUND The Texas Proprietary School Act, Chapter 32, Education Code, provides for the regulation of proprietary schools in Texas by the Central Education Agency.The Act provides numerous exemptions from the definition of "proprietary school," including various exemptions for trade associations who conduct classes for the benefit of their members. However, there has been confusion as to the status under the Texas Proprietary School Act of plumbing associations and training programs approved by the Texas State Board of Plumbing Examiners which conduct training programs to educate their membership in technical, business and license examination preparation classes. PURPOSE HB 2200 would exempt from regulation as a proprietary school, a course or training program conducted by plumbing associations which provides instructions for plumbing tests and programs required for licensing, certification, or endorsement and for the purpose of providing continuing education programs approved by the Texas State Board of Plumbing Examiners. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 32.12 (a), Education Code. (11)(B) exempts from the definition of "proprietary school" a course or training program conducted by plumbing trade associations for the purpose of preparing students for plumbing tests and programs required for licensing, certification, or endorsement and for the purpose of providing continuing education programs approved by the Texas State Board of Plumbing Examiners. SECTION 2. Change in law applicable to courses beginning on or after effective date. SECTION 3. Effective date: September 1, 1995. SECTION 4.
