BILL ANALYSIS H.B. 2227 By: Wilson (Barrientos) Finance 05-25-95 Senate Committee Report (Unamended) BACKGROUND Institutions of higher education, faced with cut-backs and budgetary constraints, are sometimes unable to offer unrestricted merit-based scholarships. In an effort to remedy this, students have looked for fundraising alternatives. PURPOSE As proposed, H.B. 2227 allows authorized entities recognized by institutions of higher education to conduct raffles. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3, Article 179f, V.T.C.S. (Charitable Raffle Enabling Act), by amending Subsection (i) and adding Subsection (l), as follows: (i) Prohibits an organization from permitting a person who is not a member of the organization or who is not authorized by the organization to sell or offer to sell raffle tickets. (l) Requires an institution of higher education to allow the sale of tickets to a raffle by a student organization recognized by the institution at any facility of the institution, subject to reasonable time, place, and manner restrictions. SECTION 2. Emergency clause. Effective date: upon passage.
