BACKGROUND

The 73rd Legislature created South Texas Community College in
McAllen, Texas.  The authority to elect a board of trustees will be
necessary when the college is confirmed.

PURPOSE

As proposed, H.B. 2314 sets forth guidelines relating to the
election of the board of trustees of South Texas Community College.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 130.0311, Education Code, by amending
Subsections (c), (m), and (n) and adding Subsection (o), as
follows:

     (c)  Provides that South Texas Community College is governed
     by an initial board of trustees (board) composed of seven
     members appointed by the governor to serve until August 31,
     2000, unless before that date an election is held at which a
     majority of the votes cast at the election favor the
     confirmation of the college.  Requires as soon as practicable
     after the confirmation election the members of the initial
     board to draw lots to determine when their terms expire.  Sets
     forth the terms of expiration of board members.
     
     (m)  Sets forth election dates for members of the board if
     South Texas Community College is confirmed as provided by this
     section.
     
     (n)  Created from existing text.
     
     (o)  Redesignates existing Subsection (n).
     
     SECTION 2.     Emergency clause.
           Effective date:  upon passage.
