BILL ANALYSIS H.B. 2373 By: Junell (Montford) Jurisprudence 5-17-95 Senate Committee Report (Unamended) BACKGROUND The Texas Supreme Court is required to make biennial recommendations to the legislature regarding changes in the number and allocation of courts of appeal. The Judicial District Board, which determines the apportionment only of district courts, reports its recommendations after the decennial census. There is currently no coordination between the reporting periods even though district court decisions are appealed to the courts of appeals. PURPOSE As proposed, H.B. 2373 requires the supreme court to recommend to the legislature convening in the third year following the year in which the federal decennial census is taken any needed changes in the number or allocation of those courts. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 74.022(c), Government Code, to require the supreme court to recommend to the regular session of the legislature convening in the third year following the year in which the federal decennial census is taken any changes needed in the number or allocation of those courts. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause.
