BILL ANALYSIS C.S.H.B. 2382 By: McDonald 03-28-95 Committee Report (Substituted) BACKGROUND Currently, food service workers are required to complete a standardized training program to receive accreditation. Many multi-unit operations, such as grocery stores, utilize national training programs, which vary from the standardized format and therefore cannot be used in Texas. PURPOSE H.B. 2382 allows the Texas Department of Health to approve individual training programs for food service entities. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Adds Subsection 438.043(e), Health and Safety Code, allowing the Department of Health to modify standardized program requirements for a course used in training employees under the common control of a single entity. SECTION 2. Amends Section 438.046(b), Health and Safety Code, specifying that food service worker trained in a course modified for a particular entity meet a local jurisdiction's training and testing requirements only for food service performed for that entity. SECTION 3. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute for H.B. 2382 contains nonsubstantive language changes recommended by the Legislative Council. SUMMARY OF COMMITTEE ACTION H.B. 2382 was considered by the committee in public hearing on March 28, 1995. The committee considered a complete substitute for the bill.
