BILL ANALYSIS H.B. 2382 By: McDonald (Armbrister) State Affairs 5-22-95 Senate Committee Report (Unamended) BACKGROUND Food service workers are required to complete a standardized training program to receive accreditation. Many multi-unit operations, such as grocery stores, utilize national training programs, which vary from the standardized format and therefore cannot be used in Texas. PURPOSE As proposed, H.B. 2382 authorizes the Texas Department of Health to approve individual training programs for food service entities. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 438.043, Health and Safety Code, by adding Subsection (e), to authorize the Texas Department of Health to modify the requirements of Subsection (a), (b), or (c) for a course used in training employees under the common control of a single entity. SECTION 2. Amends Section 438.046(b), Health and Safety Code, to provide that a food service worker trained in a course for the employees of a single entity is considered to have met a local health jurisdiction's training and testing requirements only as to food service performed for that entity. SECTION 3. Emergency clause. Effective date: upon passage.
