BILL ANALYSIS H.B. 2390 By: Black (Turner) State Affairs 5-16-95 Senate Committee Report (Unamended) BACKGROUND In 1989, the 71st Legislature created the High-Speed Rail Authority (authority) Act which was to be entirely privately funded. After extensive study, the project proved to be controversial, largely because the authority of eminent domain was delegated to private entities. PURPOSE As proposed, H.B. 2390 abolishes the Texas High-Speed Rail Authority. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. (a) Repealer: Article 6674v.2, V.T.C.S. (Texas High-Speed Rail Act). (b) Provides that the transfer of the power and duties of the Texas High-Speed Rail Authority (authority) as provided by Article 4, Chapter 7, Acts of the 72nd Legislature, 1991, does not take effect. SECTION 2. Provides that on the effective date of this Act the authority is abolished, the terms of members of the authority's board expire, all unobligated funds of the authority are transferred to the general revenue fund, and all property and records of the authority are transferred to the Railroad Commission of Texas. SECTION 3. Effective date: September 1, 1995. SECTION 4. Emergency clause.
