BACKGROUND

Currently, there are inconsistencies between definitions in the
state and federal versions of the government code.  There is also
language which was left out of the last reworking of the Government
Code that is needed to achieve a thorough understanding of the law.

PURPOSE

H.B. 2428 proposes to eliminate the inconsistencies and lack of
clarity which are now present in the Government Code.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Sec. 411.082, Government Code is amended as follows:
"Criminal Justice Agency" means government agency or any subunit
thereof.  This      definition includes courts.  "Criminal Justice
Purpose" also includes in its definition an  activity by a criminal
justice agency.

SECTION 2.  Sec. 411.089, Government Code, is amended as follows:
Criminal history record information obtained under subsection (a)
may be used by the criminal justice agency for criminal justice
purposes.

SECTION 3.  Sec. 411.124, Government Code, is amended as follows:
Any political subdivision that employs or licenses drivers of
public transportation    vehicles is entitled to be provide record
of conviction information from the department.

SUMMARY OF COMMITTEE ACTION

H.B. 2428 was considered by the Committee on Public Safety in a
public hearing on March 28, 1995.  The bill was reported favorably
without amendment , with the recommendation that it do pass and
printed, by a record vote of 5 ayes, 0 nays, 0 pnv, 4 absent.
