BILL ANALYSIS H.B. 2449 By: Duncan (Cain) Finance 5-23-95 Senate Committee Report (Unamended) BACKGROUND The House Higher Education Committee received an interim charge to study the compliance and paperwork burden placed on institutions of higher education by the Texas Higher Education Coordinating Board. PURPOSE As proposed, H.B. 2449 deletes the requirement of a state agency that expends appropriated funds to submit a binding encumbrance report to the Legislative Budget Office; and the requirement of an agency or institution to submit to the governor a report on the status of audits. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 403.021(a), Government Code, to delete the requirement of a state agency that expends appropriated funds to submit a binding encumbrance report to the Legislative Budget Office. SECTION 2. Amends Section 5, Article 6252-5g, V.T.C.S., to delete the requirement of an agency or institution, during January and June of each year during which an audit is being conducted, to submit to the governor a report on the status of the audit. Makes a conforming change. SECTION 3. Effective date: September 1, 1995. SECTION 4. Emergency clause.
