BACKGROUND

Added to the statute in 1989, the interagency coordination council
was designed to coordinate the activities of its member agencies
concerning the regulation of solid waste and solid waste management
facilities and the enforcement of the applicable solid waste laws
and rules.  The member agencies were the Water Commission, the Air
Control Board, the Department of Health and the Railroad
Commission. 

Since then, the Department of Health's municipal solid waste
program was transferred to the Texas Water Commission.  On
September 1, 1993 the Texas Water Commission became the Texas
Natural Resource Conservation Commission (TNRCC), and the Air
Control Board was abolished - its powers, duties, responsibilities
and functions were transferred to the newly established TNRCC.  

The TNRCC and the Railroad Commission now have a Memorandum of
Understanding regarding oil and gas related wastes, but all other
regulatory waste programs fall under the authority of the TNRCC. 
These two agencies regularly review their Memorandum of
understanding, therefore there is no longer a need for the
interagency coordination council.

PURPOSE

HB 2579 will eliminate a statute that is no longer necessary.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1:  Repeals Section 361.021, Health and Safety Code.

SECTION 2:  Emergency clause.


SUMMARY OF COMMITTEE ACTION

HB 2579 was considered in a public hearing on March 21, 1995.  HB
2579 was reported favorably without amendment, with the
recommendation that it do pass and be printed, and be sent to the
Committee on Local and Consent Calendars by a record vote of six
(6) ayes, no (0) nays, no (0) pnv, and three (3) absent.
