BILL ANALYSIS H.B. 2579 By: Howard (Brown) Natural Resources 05-17-95 Senate Committee Report (Unamended) BACKGROUND The interagency coordination council was designed to coordinate the activities of the Water Commission, the Air Control Board, the Department of Health, and the Railroad Commission concerning the regulation of solid waste and solid waste management facilities and the enforcement of the applicable solid waste laws and rules. The Department of Health's municipal solid waste program has since been transferred to the Texas Water Commission. On September 1, 1993 the Texas Water Commission became the Texas Natural Resource Conservation Commission (TNRCC), and the Air Control Board was abolished and its powers, duties, and functions were transferred to the newly established TNRCC. The TNRCC and the Railroad Commission now have a memorandum of understanding regarding oil and gas related wastes, but all other regulatory waste programs fall under the authority of the TNRCC. These two agencies regularly review their memorandum of understanding, therefore, eliminating the need for the interagency coordination council. PURPOSE As proposed, H.B. 2579 repeals Section 361.021, Health and Safety Code, abolishing the interagency coordination council. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 361.021, Health and Safety Code (Interagency Coordination Council). SECTION 2. Emergency clause. Effective date: upon passage.
