BACKGROUND

Article 6674m, V.T.C.S. provides for partial payments for highway
improvement contracts.  The statute authorizes partial payments of
95% of the value of the work done and requires retainage of the
remaining 5% of the contract price until the entire work is
completed and accepted.

PURPOSE

To exempt state highway improvement contracts for maintenance and
for the making of plans and surveys from existing contract
retainage requirements.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency, or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Article 6674m, V.T.C.S. to exempt from retainage
requirements contracts for maintenance and contracts for plans and
surveys preliminary to construction, reconstruction, or maintenance
of a state highway.

SECTION 2.  Provides that this change in law applies only to a
contract awarded on or after the effective date of this Act.

SUMMARY OF COMMITTEE ACTION

Pursuant to a public notice posted on March 23, 1995, at 7:36 p.m.,
the House Committee on Transportation met in a public hearing on
Wednesday, March 29, 1995 at 2:00 p.m. in Room E1.014 of the
Capitol Extension and was called to order at 2:10 p.m. by the
Chair, Representative Clyde Alexander.  The Chair laid out H.B.
2582 and recognized Representative Alexander to explain H.B. 2582. 
The Chair recognized the following person to testify in support of
H.B. 2582.  Steve Stagner, Consulting Engineers Council of Texas. 
There were no persons testifying in opposition to H.B. 2582.  The
Chair left H.B. 2582 pending before the Committee.  Pursuant to a
public notice posted on March 30, 1995 at 6:02 p.m., the House
Committee on Transportation met in a public hearing on Wednesday,
April 5, 1995 at 2:00 p.m. or upon adjournment, in room E1.014 of
the Capitol Extension and was called to order at 6:30 p.m. by the
Chair, Representative Clyde Alexander after the House recessed. 
The Chair laid out H.B. 2582 by Alexander, which was pending before
the Committee.  Representative Alonzo moved that the Committee
report H.B. 2582, without amendments, to the full House with the
recommendation that it do pass.  The motion prevailed by the
following vote: Ayes (7), Nayes (0), Absent (2), Present not voting
(0).
