BACKGROUND

     Currently under Article 1.03A, Insurance Code, the Texas'
Insurance Commissioner is delegated rulemaking authority by the
Texas Legislature to adopt necessary rules and regulations
for the conduct and execution of the duties and functions of the
Texas Department of Insurance as authorized by a statute.  Any rule
or regulation adopted in accordance with this Article must be for
general and uniform application and shall be published by the
Commissioner.  Such published rules shall be kept current and shall
be available in a form convenient to all interested parties.

PURPOSE

     As proposed, House Bill 2647 would require that rules and
regulations adopted by the Insurance Commissioner, as authorized by
appropriate statute would also reference the statute that
authorizes the adoption of the rule or regulation.

RULEMAKING AUTHORITY

     It is the committee's opinion that this bill does not
expressly grant any additional rulemaking authority to a state
officer, department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.

     Amends Article 1.03A, Insurance Code, by requiring that the
rules and regulation that the Commissioner adopts as authorized by
a statute, must also reference the statute that authorizes such
rule or regulation.  Provides for the nature of these rules, their
application, and how the published rules are to be maintained. 


SECTION 2.  Emergency Clause and Effective Date

SUMMARY OF COMMITTEE ACTION

     In accordance with House rules, H.B. 2647 was heard in a
public hearing on March 22, 1995.  The Chair laid out H.B. 2647 and
recognized Representative Dutton to explain the bill.  The Chair
recognized the following person to testify in support of H.B. 2647:
     John Abdnor, representing himself.  No one testified in
opposition to or neutrally on H.B. 2647.

     The Chair recognized Representative G. Lewis who moved the
Committee report H.B. 2647 as filed to the full House with the
recommendation that it do pass, be printed and be sent to the
Committee on Local and Consent Calendars.  Representative Shields
seconded the motion and the motion prevailed by the following vote: 
AYES (7); NAYES (0); ABSENT (2); PNV (0).
