BACKGROUND

The Pension Board consists of three active police officer members
of the fund who are elected by the membership; two appointed
civilian trustees; and, two trustees appointed by virtue of
position or appointment, those being a representative of the Mayor
and the City Treasurer.  The elected trustees are elected for a
term of three years and there is no statutory provision for removal
of a trustee prior to term expiration.  The two civilian members
are appointed by the elected members of the board for a two year
term and there is no statutory provision for removal of a civilian
trustee prior to term expiration.

PURPOSE

To provide a method for removing an elected or appointed civilian
trustee whose acts are detrimental to the pension system.  Removal
would be initiated either by a petition for removal signed by at
least one-third of the members of the pension fund and a recall
election held in which a majority of the members participated; or,
initiated by a vote of five members of the board together with a
decision of a hearing examiner to remove the trustee.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency, or institution.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Article 6243g-1, Police Officers' Pension System
in cities of 1,200,000 or more, V.T.C.S., by adding Section 4A(a)-(h), to allow for the recall of an elected Trustee or an appointed
civilian Trustee.
