BILL ANALYSIS H.B. 2754 By: Pitts 04-20-95 Committee Report (Unamended) BACKGROUND Current law, (Vernon's Texas Civil Statutes, Article 6701a-2) does not provide for a definition of portable buildings in reference to transportation laws. Recent changes in manufacturing methods of portable buildings result in the buildings being shipped in components rather than fully assembled as in the past. Some confusion has resulted in the enforcement of transportation laws dealing with portable buildings. PURPOSE H.B. 2754 adds the definition of portable building unit to Art. 6701a-2 to include the units in their unassembled state. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1: Amends V.T.C.S., Article 6701a-2, by defining portable building units as pre-fabricated structures and other components delivered by the manufacturer as a complete inspected unit with a distinct serial number whether they are fully assembled, partially assembled or completely unassembled. SECTION 2: Emergency clause. SUMMARY OF COMMITTEE ACTION Pursuant to a public notice posed on April 13, 1995 at 4:14 p.m., the House Committee on Transportation met in a public hearing on Wednesday, April 19, 1995 at 2:00 p.m., or upon adjournment, in Room E1.014 of the Capitol Extension and was called to order at 2:16 p.m. by the Chair, Representative Clyde Alexander. The Chair laid out H.B. 2754 and recognized Representative Pitts to explain H.B. 2754. There were no witnesses in support of, or in opposition to H.B. 2754. The Chair left H.B. 2754 pending before the Committee. Pursuant to a public meeting announced from the House Floor on April 20, 1995, in accordance with the House Rules, the House Committee on Transportation met in a formal meeting on the House Floor, at Desk 22, on Thursday, April 20, 1995, and was called to order by the Chairman, Representative Clyde Alexander at 4:12 p.m. The Chair laid out H.B. 2754, which was pending before the Committee. Representative Clemons moved that the Committee report H.B. 2754, without amendments, to the full House with the recommendation that it do pass. The motion prevailed by the following vote: Ayes (5), Nayes (0), Absent (4), Present not voting (0).
